WhatsApp and Business Crime Reduction Partnerships

It is sometimes believed that WhatsApp groups are exempt from the obligations of the Data Protection Act 1998. This is not the case.

The DPA offers exemptions for not-for-profit organisations, but narrow and important conditions apply. One of these is that processing must be only for the purposes of establishing or maintaining membership, supporting a not-for-profit body or association, and providing or administering activities for either the members or those who have regular contact with the group. Exchanging personal data for the purposes of managing or monitoring banning schemes etc would not fulfil this condition.
